Terms & Conditions – MAAK Properties

These Terms & Conditions (“Terms”) govern your use of services provided by MAAK Properties (“Company”, “we”, “our”, “us”). By engaging with us in any manner (including calls, WhatsApp, website, or in person), you agree to these Terms
1. Nature of Services
MAAK Properties provides:
- Real estate brokerage (buy, sell, rent)
- Property advisory and consulting
- Property marketing and listing services
- Lead generation and client matching
The Company acts solely as a facilitator/intermediary and is not a party to any transaction unless expressly stated.
2. User Obligations
You agree that:
- All information provided by you is true and accurate
- You will not misuse listings, data, or contacts provided
- You will comply with all applicable laws (including RERA, tax laws, etc.)
Any misuse may lead to termination and legal action.
3. Brokerage, Commission & Fees
- Brokerage/commission shall be payable as mutually agreed prior to the transaction
- Commission becomes due upon:
- Successful introduction of a party, OR
- Deal negotiation, OR
- Finalization of transaction
- Government taxes (GST or others) are extra
Anti-Bypass Clause
If MAAK Properties introduces a buyer, seller, tenant, or property, and the transaction is completed directly or indirectly without involving us, full brokerage shall still be payable.
4. Payment Terms
- Payments may be made via bank transfer, cheque, UPI, or other agreed methods
- Delayed payments may attract interest and recovery action
- In case of non-payment, the Company reserves the right to suspend services and initiate legal proceedings
5. Property Information Disclaimer
- Property details may be sourced from owners, developers, brokers, or third parties
- The Company does not guarantee accuracy, completeness, or reliability of such information
- Prices are indicative and subject to change
Users must independently verify all details before entering into any transaction.
6. Site Visits & Transactions
- Site visits are arranged as a facilitation service only
- Final negotiations and agreements are strictly between the concerned parties
- MAAK Properties shall not be responsible for any disputes arising between parties
7. Marketing & Communication
You agree that MAAK Properties may contact you via:
- Calls
- SMS
You may opt out of marketing communication at any time.
8. Use of Platform & Data
If you access our website, CRM, or any digital system:
You agree not to:
- Copy, scrape, or extract data
- Misuse contact details
- Attempt unauthorized access
- Use data for competing or unlawful purposes
Violation may result in legal action.
9. Intellectual Property
All content including:
- Property listings
- Images
- Marketing material
- Branding
- Software or systems
is the exclusive property of MAAK Properties and cannot be used without written permission.
10. Third-Party Services
We may connect you with:
- Builders / developers
- Brokers / channel partners
- Financial institutions
MAAK Properties shall not be liable for:
- Their actions or commitments
- Delays or defaults
- Quality or performance of services
11. Limitation of Liability
MAAK Properties shall not be liable for:
- Financial losses from property transactions
- Incorrect or incomplete third-party information
- Delays, cancellations, or deal failures
- Any indirect or consequential damages
All decisions are taken at your own risk.
12. Indemnity
You agree to indemnify and hold harmless MAAK Properties from any claims, damages, or disputes arising from:
- Incorrect information provided by you
- Misuse of services
- Violation of these Terms
13. Cancellation & Refund Policy
- Brokerage once earned is non-refundable
- Any marketing or service cost already incurred is non-refundable
- Specific cancellation terms may be agreed separately
14. Termination of Services
MAAK Properties reserves the right to:
- Refuse or discontinue services
- Block access to systems
- Take legal action
in case of misuse, fraud, or violation of these Terms.
15. Force Majeure
We shall not be liable for delays or failure in performance due to:
- Natural disasters
- Government actions
- Technical failures
- Events beyond reasonable control
16. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India.
All disputes shall be subject to jurisdiction of Gurgaon, Haryana courts.
17. Amendments
MAAK Properties reserves the right to update or modify these Terms at any time. Continued use of services implies acceptance of updated Terms.
